ARE YOU MAN ENOUGH? -  TERMS AND CONDITIONS OF ENTRY

The Promoter of the Zoo/Royal Marines ‘Are you Man Enough’ competition (“the Competition”) is Bauer Advertising ("BA"), whose offices are at Endeavour House, 189 Shaftesbury Avenue, London, WC2H 8JG

All entrants to the Competition must read and accept these Terms and Conditions as a condition of entry.

  1. The Competition is open only to residents of the UK. All entrants must be aged 16 years or over at the time of entering the competition. The Promoter reserves the right to verify the age of all entrants and remove any entrant who is under 16 years old.  If an entrant aged 16 or 17 would like to attend the regional events then a parent or guardian must be in attendance.  Parental permission must be acquired for a 16 or 17 year old to attend the final should they be successful.
  1. Employees of any of the Armed Forces, UK or otherwise, regular or reserve, COI and EA, their families, agencies and anyone connected with the challenge and promotion shall not be entitled to enter the Competition.
  1. All entrants must be physically fit and healthy and sign a medical waiver before they partake in the physical test. The Promoter reserves the right to remove a Participant/Selected Entrant (as defined below) who, in their sole opinion, is not of the fitness level required, and/or does not have the capability, to participate in the activities at the Final (defined below). The Promoter excludes all liability as a result of a Selected Entrant being replaced for any reason. 
  1. For reasons of safety, the Promoter and/or its representative reserves the right to require that the Participant/Selected Entrant at each regional event submits to an alcohol/drugs test upon request, or request that they produce a medical certificate or statement from their GP, confirming that they are able to enter the Event. The Promoter reserves the right to refuse a Selected Entrant’s participation in any part of the Competition and promotion, if it has cause to believe that a Selected Entrant is under the influence of drink or drugs or is otherwise unfit/unable to participate.  A Selected Entrant will be required to sign a release/disclaimer confirming their state of health and releasing the Promoter from any responsibility for health problems or injury arising from his/her participation in the Event before the Event starts, as some risk is involved in the Event due to the high performance characteristics of the tests and the nature of any associated training being undertaken.  The Selected Entrant must adhere to any instructions and signals given by the Promoter and/or its representative during any part of the Event. All instructions and directions will be given in English only, the official language of the Armed Forces.
  1. To enter, entrants must register on www.zootoday.co.uk/areyoumanenough. No purchase is necessary. Entrants must register their details online, create a profile and answer the Commando State of Mind questions. The results of the physical test will determine who attends the final at Commando Training Centre Royal Marines (CTCTRM) in Lympstone, Devon in 2008.  It is recommended that participants undertake a progressive training programme to prepare for the physical tests. Entrants are also recommended to attend training sessions with British Military Fitness in preparation for the competition.
  1. The Final will consist of a weekend of physical tests at CTC Royal Marines Lympstone, UK in April 2008.  The tests will include:  the Royal Marines Fitness Assessment, the Battle Physical Training test and the Endurance Course as detailed on the Royal Marines website http://www.royalmarines.mod.uk.  These tests may be moderated to accommodate the level of fitness of the finalists, but will be judged in accordance with the Royal Marines scoring system to ensure consistency and fairness.
  1. The Closing Date for registering for the competition online will be 7th March 2008. The ten finalists will be informed by 14th April in order to prepare for the Final.
  1. The Promoter reserves the right to reject on-line registrations which are not properly completed. The Promoter is not responsible for on-line registrations which fail to be delivered for any reason.  Proof of submitting an on-line registration is not proof of delivery. 
  1. The Winner selected at the Final will be appointed as the ‘Man of the Year’.  The prize will consist of £3,000 of “Boys Toys” (gadgets) and a once-in-a-lifetime, money-can’t-buy Royal Marines “Experience”. Due to the nature of this prize and The Royal Marines being an active force the money-can’t-buy prize may change.  However it could consist of one of the following:  a flight in a fighter jet, fast rope out of a helicopter, ice climbing in Scandanavia, drive a Viking, parachuting, going in The Dunker (helicopter escape simulator), ride in a Rigid Inflatable Boat.  The prize will be determined by The Royal Marines at the time of awarding the winner based on availability of resource and equipment and the operational tempo of the Corps. The Winner will be bound and agrees to abide by any terms imposed by any third parties providing products or services, as part of the prize. 
  1. The prize for the Are You Man Enough Challenge is non-transferable and there is no cash alternative.  The Promoter reserves the right to substitute an alternative prize (or any part of the prize) of equal or greater value, determined at the sole discretion of the Promoter, in the event of any circumstances whatsoever which result in the Promoter being unable to offer the prize to the competition Winner. 
  1. Success in the Are You Man Enough? Competition isn’t a guarantee that any participants would be fit enough or suitable to serve as a Royal Marines Commando. Entrance to the Royal Marines Commandos is determined by passing academic and psychometric tests, an interview, pre-joining fitness test, medical assessment, and the PRMC, or POC and AIB for Officers.   1. The Promoter reserves the right to replace the Winner should the Winner act in any way which is contrary to the reputation or interests of the Promoter, its affiliates, and any of their brands, including the Royal Marines and BAUER, or be unable to participate in any of the post competition activities. The Promoter will not be obliged to offer any alternative prize(s) where the Winner is replaced in accordance with these Terms and Conditions.
  1. The Winner may be required to participate in publicity/post Competition activities throughout the promotional period of 12 months from the Final. By entering the Competition, participants accept and agree that they may feature in Zoo magazine, possibly on a regular basis.
  1. The details of the Winner (Name and Email only) will be available for 1 month after end May 2008 by sending a SAE to Are You Man Enough, Project Management, Bauer Advertising, Endeavour House, 189 Shaftesbury Avenue, London WC2H 8JG.
  1. The Promoter reserves the right to cancel, terminate, temporarily suspend or alter this Competition and promotion in the event of technical or any other difficulties, or an event of force majuere, with no liability whatsoever to any entrants, participants, Selected Entrants, the Winner or any third parties.  The Promoter accepts no liability or responsibility for the acts, omissions, defaults or consequences arising from the actions of any hotel, any transportation companies concerned, Selected Entrants, the Winner, or any third parties arising from any circumstances over which the Promoter has no control whatsoever. The Selected Entrants and the Winner will be responsible for all other costs prior to and after fulfilment of the competition and promotion and not otherwise provided herein, including any additional excursions/trips or internal flights he/she may take.
  1. Without prejudice to any other provisions set out in these Terms and Conditions, the decision of the Promoter in all stages of the Competition and the promotion and matters arising there from is final and no correspondence will be entered into.
  1. The internet is not a secure medium and information submitted to this Competition may be accessed by third parties.
  1. Entrants are deemed to have accepted these Terms and Conditions by participating in this Competition.
  1. Bauer Publishing, and/or its associated companies, will keep details of all entrants on a database.  By entering the Competition, entrants give their consent to Bauer and its associated companies to use this information and to pass this information to other relevant third parties (such as the Royal Marines) to enable the processing of this promotion, and to enable the fulfilment of prizes. Data shall also be held to verify the details of each entrant and for the prevention of fraud.  Where an entrant has given the requisite consent, Bauer may share this information with other companies, in order that the entrant may be sent details of those companies' goods and services by email and/or SMS.
  1. This Competition and these Terms and Conditions are governed by English Law and are subject to the exclusive jurisdiction of the English Courts.
